Terms of Service

Welcome to Rick's Collectibles. These Terms of Service ("Terms") govern your access to and use of rickscollectibles.shop (the "Site") and every purchase made through it. By accessing the Site or placing an order, you agree to these Terms and to the policies incorporated into them by reference: our Shipping Policy, Refund & Return Policy, Pre-Order Policy, and Privacy Policy. Please read them carefully — they are written to be understood, not to hide things.

1. Who We Are

We sell toys & trading cards and collectibles to customers in the United States. We are an independent retailer; the manufacturers of the products we sell are not parties to your purchase from us.

2. Eligibility & Use of the Site

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm that the information you provide is accurate and that you are authorized to use the payment method supplied. You are responsible for keeping your account credentials (if any) confidential and for all activity under them.

3. Products, Descriptions & Pricing

• We make every reasonable effort to describe and photograph products accurately. Screen colors vary, and photographs are illustrative of the actual item or product line as described in the listing.
• For antiques and vintage items, reasonable signs of age and wear consistent with the item's stated condition are inherent characteristics, not defects. Each listing describes condition specifically.
• All prices are in US dollars and include free shipping; applicable sales tax is shown at checkout.
• We reserve the right to correct pricing or descriptive errors, limit quantities, and refuse or cancel any order — including after payment has been received — in cases of error, suspected fraud, or unavailability. If we cancel a paid order, you receive a full refund promptly. We will never cancel an order simply because an item's market value increased.

4. Orders & Payment

Placing an order constitutes an offer to purchase, which we may accept or decline. Payment is collected at the time of purchase via Shopify Payments, PayPal, Stripe. You represent that you are authorized to use the payment method provided. You are responsible for supplying a complete, accurate shipping address; we are not responsible for delivery failures caused by an incorrect address supplied at checkout, though we will always try to help resolve them, and undeliverable packages returned to us are refunded or reshipped as described in our Shipping Policy.

5. Shipping & Delivery

Orders are processed within 3 business days and delivered within 5 to 10 business days thereafter — typically 8 to 13 business days in total — free of charge, anywhere in the United States. Transit estimates are provided by carriers and are not guaranteed. Full details, including our handling of lost, delayed, and damaged shipments, are in the Shipping Policy, which forms part of these Terms.

6. Returns & Refunds

We offer a 30 days return window from delivery, with prepaid return shipping and no restocking fees, and refunds to your original payment method within 5–10 business days of approval. Sealed collectible products must remain unopened to be returnable. Full conditions and instructions are in the Refund & Return Policy, which forms part of these Terms.

7. Pre-Orders

Pre-order items ship on or shortly after their official release date; release dates are set by manufacturers and may change. Pre-order pricing is locked at purchase, and you may cancel any time before shipment for a full refund. If a release is canceled or we cannot fulfill your pre-order, you are refunded in full automatically. The complete terms are in the Pre-Order Policy, which forms part of these Terms.

8. Chargebacks & Dispute Resolution

If any issue arises with your order — delivery delay, damage, a return, refund timing, anything — please contact us first at support@rickscollectibles.shop. Nearly every problem can be resolved quickly and directly, and we are committed to resolving legitimate issues in good faith. Initiating a payment dispute without contacting us first usually slows resolution for you; our support inbox is faster than a chargeback in almost every case.

9. Intellectual Property

All Site content created by us — including the Rick's Collectibles name, logo, product photography, page text, and design — is owned by or licensed to Rick's Collectibles and may not be copied, reproduced, or used without our written permission. Third-party product names, logos, and trademarks (including trading card game brands) are the property of their respective owners and are used solely to identify the genuine products offered for sale; no affiliation with or endorsement by those owners is implied.

10. Prohibited Uses

You agree not to use the Site:

• For any unlawful purpose or in violation of any applicable law or regulation;
• To attempt unauthorized access to our systems, other customers' data, or our suppliers' systems;
• To interfere with the proper functioning or security of the Site, including by scraping, flooding, or introducing malicious code;
• To engage in fraudulent transactions, reseller fraud, or abuse of our return or pre-order policies.

We may refuse service, cancel orders, and terminate access for anyone who violates these Terms.

11. Disclaimer of Warranties

The Site and its products are provided "as is" and "as available," except as expressly stated in these Terms and our policies (including our return policy) or as required by applicable law. Descriptions of antique and vintage items reflect their age and condition as stated in each listing. Nothing in this section limits warranties that cannot be disclaimed under your state's law.

12. Limitation of Liability

To the fullest extent permitted by law, Rick's Collectibles and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any products purchased through it. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Rick's Collectibles from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site, to the extent permitted by law.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles. Any disputes arising under these Terms are subject to the jurisdiction of the courts located there, except where applicable law gives you the right to proceed elsewhere.

15. Severability, Waiver & Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Site and supersede prior understandings on that subject.

16. Changes to These Terms

We may update these Terms from time to time. The current version is always posted on this page with its effective date. Changes apply prospectively; continued use of the Site after changes are posted constitutes acceptance.
